TERMS AND CONDITIONS

This Agreement is between First Canadian Title Company Limited (“FCT”) and you the client (hereinafter “client”, “you” or “your”, which refers to the individual(s) requesting a home inspection at the property noted in Step 2). FCT is a services company responsible for the booking services of a home inspection through inspection.fcthome.ca. Home inspections are performed by an FCT Approved Inspector (criteria includes, but is not limited to the appropriate qualifications, certifications and/or standards determined by FCT, in its sole discretion).

FEES:

You agree to pay the fee quoted to you for the Home Protection Solutions Inspection, which shall be paid upon requesting FCT to book your home inspection. Should you fail to timely pay the agreed upon fee(s), your home inspection will not be scheduled. If the inspection is cancelled within 24 hours of the appointment time, a cancellation fee of 50% of the fee will apply.

REPORT:

The Home Protection Solutions Inspection report is for the use of the client. The client consents to the collection, use and sharing of data used or provided in the inspection report to be provided to FCT, for their use in enrollment in the program, and for analyzing, aggregating, commercializing and reporting on the data, which may be provided to third parties in connection with ancillary services.

LIMITATION OF LIABILITY:

THE LIABILITY OF FCT ARISING OUT OF THE SERVICES, THE HOME PROTECTION SOLUTIONS INSPECTION AND REPORT, FOR ANY CAUSE OF ACTION WHATSOEVER, WHETHER IN CONTRACT OR IN NEGLIGENCE, IS LIMITED TO A REFUND OF THE FEES THAT HAVE BEEN CHARGED FOR THIS INSPECTION, OR $1,000, WHICHEVER IS GREATER. FCT MAKES NO WARRANTIES, CONDITIONS OR REPRESENTATIONS, WRITTEN OR ORAL, EXPRESS OR IMPLIED, IN FACT OR IN LAW.
